A. The Development commenced with construction of the Infra-structure services which is now nearing completion.
2. Q. What services shall the Developer provide to the Development?
A. The Developer shall develop infra-structure services such as the following:
· Single entrance/exit.
· Roads and pavements shall be interlocked.
· Eighteen meter two way drive lined with trees in the middle.
· Many path walks to the beach.
· Aesthetically friendly boundary wall on the side of B2 Highway and the Southern part of the Development to prevent unauthorized/wrongful entry in the Development by vehicles, quad bikes, and thereby providing additional security to the Development.
· Palm trees to be planted in and around the Development.
· Telephone line connections to each Property.
· Drinking water connection to each Property.
· Electricity connections to each Property.
· Electricity substations and reticulations.
· Sewerage services to each Property.
· Storm water services within the Development.
· Connection to each Property with semi-purified water to encourage vegetation and plant life while saving precious water.
· Provision for security surveillance cameras to be installed within the Development.
· All General Residential erven are provided with a high voltage electrical cable connection and telephone lines therefore avoiding damage to the road curbs and pavements in the future.

3. Q. Who is the Developer?
A. The Developer is One & Only Holiday Resort (Proprietary) Limited.

4. Q. Who owns the land?
A. The Developing Company.
5. Q. How shall ownership of properties be registered?
A. Each property (erf) shall have Full Title.
6. Q. Is the Purchaser allowed to register the property into a Close Corporation / Private Company (PTY) Ltd?
A. The Purchaser can register the property in a Close Corporation, Trust or any other legal entity.
7. Q. What form of security controls shall be provided?
A. Surveillance cameras shall be installed in various places within the Development to ensure a safe environment.
8. Q. Property owners may select any Building Contractor or shall be a panel of building
Contractors to select from?
A. You may select the Building Contractor of your choice subject to that the Building Contractor is registered with the respective Authority and is acquainted with the Architectural Guidelines and Conditions and sign the contractors Code of Conduct and Conditions prior starting the construction.
9. Q. Is any conditions regarding the building contractors activity?
A. Certain conditions relating to building contractors activity in Afrodite Beach has been
adopted. The primary intention of these conditions is to ensure that all building activities are conducted with the minimum of inconvenience and disruption to residents and avoiding damage to roads, kerbs, pavements, and infra-structure services. A Contractors Code of Conduct and Conditions shall be signed by the Contractors and Owners before starting any building works.
10. Q. Can I subdivide my property?
A. No subdivision of any Single Residential Erven shall be permitted.
11. Q. Can I rezone my property?
A. No rezoning of any Single Residential Erven shall be permitted. The following single residential erven may apply for consent use zoning such as Doctors, Attorneys, Dentists, a Pre-Primary School, Financial Services, Banking Services, Estate Agents, Engineers, Architects, Town Planners, and Insurance Service, being the following erven: 191, 192, 193, 194, 195, 196, 197, 198, 199, 200, 201, 202 and 286, 287, 288, 289. This is subject to the approval of such application by the Developer and the Walvis Bay Municipality.
12. Q. Can I consolidate my property?
A. No consolidation between any Single Residential erven shall be permitted.
13. Q. What is the construction period limit?
A. The Purchaser, its successors in title and assigns shall start with construction of a building on the property within 24 (twenty four) months from the date of registration of transfer of the property into the name of the Purchaser.
14. Q. The Owner and Estate Agents are permitted to display any sign such as “For Sale” “Sold”
etc?
A. Owners or Estate Agents are strictly prohibited from displaying signs on any property.
15. Q. Is the Owner of the property allowed to change the Architectural Guidelines?
A. The Architectural Guidelines and Conditions may only be changed by the Developer who has
the right to vary, retract or add to the Architectural Guidelines and Conditions.
16. Q. Who shall indicate to the Owner the direct adjust street pavement level?
A. The Developer shall at his discretion indicate the direct adjust street pavement level to the
Owner.
17. Q. Will I be allowed to extend or alter my home?
A. Yes, subject to the Owner complying with the Architectural Guidelines and Conditions and
submitting of such plans to the Aesthetic committee and the Walvis Bay Municipality for
approval.
18. Q. What is the minimum size of a building to be erected on any Single Residential Erven?
A. Buildings erected on any Single Residential Erven shall be a minimum of 250m2.
19. Q. Can Owners be permitted to fence their site?
A. The Afrodite Beach Development shall be a secure Estate surrounded by an aesthetically
friendly boundary wall on the side of B2 Highway and Southern part to prevent unauthorized/wrongful entry in the Development by vehicles, quad bikes, and thereby providing additional security to the Development. The following materials are strictly prohibited for any boundary wall:
-Precast concrete walling -Diamond mesh fencing
-Wire mesh wooden fence -Picket fences
-Electrical shock wires or any similar materials -Steel fences
-Sheet metal -Razor fences
-Galvanised or plastic chain fence -Glass panels
-Plastic webbing, reeded or straw-like materials -Wrought iron
-Rope or other fibrous strand elements -Miniature type fencing
-Decorative precast concrete columns or balcony rails
20. Q. What is the reason for establishing the Architectural Guidelines and Conditions and who
shall secure the Architectural Guidelines in the future?
A. The Developer strongly emphasizes the necessity to have Architectural Guidelines and
Conditions to ensure a Modern Estate and not Developing a “smartie town”. The Guidelines
allow for a fairly broad range of personal choice in the external designs of the buildings however the overall character of the Development shall be identifiable by certain external elements such as:
-Restrictions on building’s heights -Building restriction lines
-Roof coverings -Boundary walls
-Roof materials -No consolidation of erven
-Colour schemes -No subdivision of erven
-External wall finishes -No rezoning
-Road and traffic behavior -Housekeeping and tidiness
-Concealed gutters and plumbing pipes
The Building Restriction lines such as the following are applicable:

The Guidelines ensure that the entire Development implements a harmonized living sphere for all residents, yet still allowing for individual Architectural designs.
For securing the continuity of the Architectural Guidelines and Conditions, the Developer shall establish the “Afrodite Beach Community Association” which Association shall be legally registered Association (not for gain) incorporated under section 21 of the Company’s Act, to safeguard the future of the common interest of the residents and the Architectural Guidelines and Conditions applicable to the Development.
21. Q. Can property Owners choose any Architect?
A. The Owners may select the Architect of their choice. Each Owner shall ensure that the
professionals appointed to perform work must be acquainted with the Architectural Guidelines and Conditions and shall ensure the professionals are registered with their respective professional bodies.
22. Q. What are the responsibilities of the Aesthetics Committee?
A. The Developer’s Aesthetics Committee shall be responsible to evaluate the compliance with the Architectural Guidelines and Conditions of any building plans applicable and submitted by the Owner of property in Afrodite Beach Development and does not take any responsibility for any technical, structural, health or safety standards or designs nor for compliance with the Walvis Bay Municipality’s building rules and regulations and no such responsibility shall arise by virtue of a building plan being approved by the Developer or the Developer’s Aesthetics Committee. The Afrodite Beach Aesthetic Committee are in an advisory capacity only regarding Architectural Guidelines and will therefore not take any responsibility or be held accountable for any judgment or ruling in this regard.
23. Q. How does Afrodite Beach fit into the Local Government structure?
A. The Development falls under the Local Council of Walvis Bay Municipality.
24. Q. Who shall be the owner of the roads and infra-structure services in Afrodite Beach?
A. The Ownership of the infra-structure, roads and services shall be handed over to the
Local Council of the Walvis Bay Municipality once completed.
25. Q. Where shall the property Owners pay Rates and Taxes, water, and electricity account?
A. The property Owner shall pay the water account, and the rates and taxes to the Local Council
of the Walvis Bay Municipality , and the electricity account to Erongo Red.
26. Q. Are pets allowed within Afrodite Beach?
A. Domestic animals shall be permitted subject to the owner having control over the pets. Residents shall not allow their pets to become a cause of friction between themselves and their neighbours. Municipal pet licenses are compulsory for any pet owners. The regulations of the Walvis Bay Municipality regarding pets shall strictly be applied. All animals must be walked with collars and a leash accompanied by the owner. Clear identification of ownership and contact details must be attached to all pets.
27. Q. Shall property owners be permitted to build swimming pools on their sites?
A. Yes
28. Q. Are mortgage bonds available for local investors?
A. Financial Institutions make available 100% bonds to prospective buyers who can qualify in terms of the normal home loan criteria applicable.

Only the Owners of the following single residential erven may apply for concern use zoning, such as a Doctors, Attorneys, Dentist, a Pre-Primary School, Financial Services, Banking Services, Estate Agents, Engineers, Architects, Town Planners, and Insurance Services, being the following erven: 191,192,193,194,195,196,197,198,199,200,201,202, and 286,287,288,289. This is subject to the approval of such application by the Developer and the Walvis Bay Municipality. Retail services are prohibited on these erven.
31. Q. Can the Owner’s paint their homes any colour they want?
A. All exterior colours such as walls and roofs must be selected from the approved colour range
provided by the Developer. The colour scheme of the exterior of all buildings, including the boundary walls shall be white or off white or the Owners may choose from the colour palette applicable to Afrodite Beach.
32. Q. Can property owners choose any Building Contractor or shall be a panel of building
Contractors to choose from?
A. You may select the Building Contractor of your choice subject to the Building Contractor is
registered as Building Contractor and is acquainted with the Architectural Guidelines and Conditions and sign the Contractors Code of Conduct and Conditions prior to starting construction.
33. Q. Can I build a wendy house on my property?
A. No Wendy homes, tool sheds or lapas may be constructed on any erf.

A. The Owner shall not be entitled to sell, alienate, cede or make over its rights under this
agreement, prior to registration of transfer of the Property into the name of the Purchaser.
35. Q. What is the legal status in case the property is registered in a Close Corporation?
A. In the case where the property is registered in a Close Corporation or in a company, a
separate Agreement of Sale of interest in the Close Corporation or shares agreement shall be signed by both parties.
36. Q. Is the Developer intending to build a jetty?
A. Yes the Developer is planning to erect a Jetty in Afrodite Beach.
37. Q. Can the Purchaser of an erf choose the Conveyancer to register the property into the name
of the purchaser?
A. No the right to choose the conveyancer remains in the discretion of the Seller.
38. Q. Is any possibility that Afrodite Beach shall have problems concerning water pressure as
currently being experienced in Long Beach and Dolphin park area?
A. No Afrodite Beach shall not have such problem because a booster pump system at the
existing water storage reservoir next to Afrodite Beach shall be installed to boost the water pressure to the higher building level. The booster pump system shall therefore contribute to an overall improvement in water pressure from Afrodite Beach to Long Beach area.
39. Q. Is there any control in regard to Quad–bikes and big trucks entering the Development?
A. To avoid damaging the roads the vehicles entering the Development shall be restricted to a
maximum weight of 10 tonnes. Quad bikes shall not be permitted to drive within the Development.
